A Pharmacy That Fills Prescriptions on Disputed Claims

Work Comp Prescription

Most pharmacies stop filling when a workers’ compensation carrier rejects a claim. That is a commercial decision on their side and a serious problem on yours: the injured worker loses access to medication at exactly the point the case becomes contested, and their recovery, and often the case, suffers for it.

Patient Direct Pharmacy keeps filling. We serve claims that are denied, controverted, under appeal or in active litigation, and we document all of it in a form that is useful when the claim is resolved.

What a disputed claim means for medication

A claim can be contested in several ways, and each has a different effect at the pharmacy counter:

  • The claim is denied outright, so no benefit is active and a retail pharmacy will refuse it
  • The claim is controverted, meaning the carrier accepts part of it and disputes another part, often a specific body part or a specific treatment
  • The claim is accepted but a particular medication is refused through utilisation review
  • The claim is in litigation and payment is effectively suspended until it is resolved

In every one of those situations the medication is still clinically necessary. The dispute is about who pays, and eventually, in most cases, someone does.

How we handle it

Submit a referral
  1. We dispense and deliver while the dispute runs, so treatment is not interrupted

  2. A dedicated litigated claims team tracks the claim’s status and every carrier rejection rather than resubmitting blindly

  3. We work with the treating physician on documentation supporting medical necessity

  4. We keep complete prescription records suitable for use in a hearing or settlement negotiation

  5. We produce itemised reporting on medication costs, outstanding balances and utilisation history

  6. There is no cost to the injured worker at any point

For attorneys

Your client keeps taking their medication and you stop fielding the calls about why they cannot. When the case reaches negotiation you have an itemised, dated medication history and cost record rather than a reconstruction. If you handle workers’ comp or personal injury volume, we can set up a standing referral arrangement so your office sends prescriptions once and we handle everything downstream.

For adjusters and nurse case managers

Even on a contested claim, keeping an injured worker on their prescribed medication usually shortens the overall claim. We give you visibility on what has been dispensed and what is pending, and we will tell you when a prescription looks inconsistent with the accepted injury rather than quietly filling it.

FAQ

Will you fill a prescription if my workers’ comp claim is denied?

Yes. We fill on denied, controverted and litigated claims and continue while the dispute is resolved, at no cost to the injured worker.

What does controverted mean?

It means the carrier accepts part of the claim and disputes another part, often a specific body part or a specific course of treatment. Medication tied to the disputed part is usually what gets rejected.

What records can you provide for litigation?

Complete prescription histories, itemised medication costs, outstanding balances and utilisation reporting, prepared for use in negotiation or at hearing.

Does the injured worker pay anything?

No. There is no out-of-pocket cost to the patient, including while a claim is disputed.
